1. WHO WE ARE

FVDlance ("FVDlance", "we", "us", "our") is an online platform that connects clients with creative experts (for example in visual identity, illustration, storyboarding, animation, motion graphics and CGI). The platform is operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS] [COMPANY NUMBER, IF ANY].

For the purposes of data protection law, we are the "controller" of the personal data described in this policy.

Contact for privacy matters: [PRIVACY CONTACT EMAIL]

2. SCOPE

This policy explains what personal data we collect when you visit or use the FVDlance website at [DOMAIN] (the "Platform"), why we collect it, who we share it with, how long we keep it and what rights you have.

3. THE DATA WE COLLECT

3.1 Account information When you create an account we collect your name, email address and password. Passwords are stored in hashed form and we cannot read them. If you sign in with Google, we receive your name, email address and profile picture from Google; we do not receive your Google password.

We also record whether your email address has been verified.

3.2 Profile information You may add information to your profile, including your first name and surname, avatar image, location, headline, bio, website, external links, and (for experts) specialty, rate and selected portfolio projects (images, titles and links).

3.3 Expert applications If you apply to become an expert, we collect the information in your application: name, email address, specialty, bio, portfolio link and/or portfolio file, and any other links you provide.

3.4 Enquiries If you send us an enquiry, we collect your name, email address and the brief or message you send.

3.5 Messages and attachments When you use the messaging feature, we store the content of your messages, any files you attach (with their file names and sizes), when each message was sent, and when it was read.

3.6 Reviews and saved experts If you leave a review of an expert, we store your rating, comment and the date. If you save an expert to your list, we record that.

3.7 Technical and session data When you sign in we create a session, and our authentication system records information such as your IP address and browser/device type (user agent) for security purposes, for example to detect suspicious sign-ins and prevent abuse. [CONFIRM WITH BETTER-AUTH / DASH PLUGIN EXACTLY WHAT IS LOGGED.]

Our hosting provider may also process standard server log data (such as IP address, request time and pages requested) to operate and secure the service.

4. HOW AND WHY WE USE YOUR DATA

We use your personal data to:

  1. Create and manage your account and let you sign in (legal basis: performance of a contract with you).
  2. Verify your email address and send you service emails such as verification links (contract).
  3. Display expert profiles, portfolio work and reviews publicly on the Platform (contract; for experts, also your consent to public display given when you apply).
  4. Review expert applications and decide whether to approve them (contract / legitimate interests in maintaining the quality of the Platform).
  5. Deliver messages between users, including in real time (contract).
  6. Respond to enquiries you send us (legitimate interests / steps taken at your request before entering into a contract).
  7. Keep the Platform secure, prevent fraud and abuse, and enforce our Terms of Service (legitimate interests).
  8. Comply with legal obligations (legal obligation).

We do not sell your personal data. We do not use your data for advertising and we do not use automated decision-making that produces legal or similarly significant effects on you.

5. WHAT IS PUBLIC

The following is visible to anyone visiting the Platform:

  • For listed experts: name, avatar, location, headline, bio, specialty, rate, website, external links, selected projects and reviews received.
  • For reviewers: your name and avatar next to your review, rating and comment. If you delete your account, your review remains but is shown as "Former member". [CONFIRM THIS IS THE DESIRED BEHAVIOUR.]

Experts can hide their own profile from the public directory at any time from their dashboard. Administrators may also remove an expert from the directory.

Messages are private between the participants of a conversation. Platform administrators can [CAN / CANNOT - CONFIRM] access messages for [e.g. safety, abuse investigation, support].

6. WHO WE SHARE YOUR DATA WITH

We use the following service providers ("processors") to run the Platform. They process data only on our instructions.

  • Vercel Inc. (USA) - website hosting and file storage (Vercel Blob) for avatars, portfolio images, application files and message attachments.
  • [DATABASE PROVIDER] - hosting of our PostgreSQL database.
  • Pusher Ltd (UK, part of MessageBird) - real-time delivery of messages.
  • Resend (USA) - sending transactional emails such as verification emails.
  • Google LLC (USA) - "Sign in with Google", only if you choose to use it.
  • Better Auth (better-auth infrastructure / dashboard service) - authentication and security monitoring. [CONFIRM PROVIDER NAME, LOCATION AND WHAT DATA IS SENT.]

We may also disclose personal data if required by law, to protect the rights, property or safety of FVDlance, our users or others, or in connection with a merger, acquisition or sale of all or part of our business.

7. INTERNATIONAL TRANSFERS

Some of our service providers are located outside [YOUR COUNTRY / the UK / the EEA], including in the United States. Where we transfer personal data internationally, we rely on appropriate safeguards such as adequacy decisions, the EU-US / UK-US Data Privacy Framework or Standard Contractual Clauses. [LAWYER TO CONFIRM PER PROVIDER.]

8. COOKIES

We only use cookies that are strictly necessary for the Platform to work, specifically to keep you signed in and to secure your session. We do not use analytics, advertising or tracking cookies. Because these cookies are strictly necessary, we do not ask for consent to them.

If we introduce analytics or other non-essential cookies in the future, we will update this policy and ask for your consent where required.

9. HOW LONG WE KEEP YOUR DATA

  • Account and profile data: for as long as your account exists.
  • Messages and attachments: for as long as both participants' accounts exist. When either participant deletes their account, the whole conversation (including the other person's messages and attachments) is deleted.
  • Uploaded files (avatars, portfolio images, application portfolio files and message attachments): permanently deleted from our file storage when you delete your account.
  • Expert applications: for as long as your account exists [OR: X months after a decision]. Applications submitted without an account are kept for [X MONTHS] unless you ask us to delete them.
  • Enquiries: [X MONTHS/YEARS]. Enquiries are kept after account deletion so we have a record of the correspondence, but are no longer linked to your account.
  • Reviews: kept after account deletion as "Former member" (see section 5).
  • Sessions: until they expire or you sign out.
  • Server/security logs: [X DAYS], as set by our providers.

We may keep data longer where needed to comply with legal obligations or to resolve disputes.

10. YOUR RIGHTS

Depending on where you live (for example under the EU/UK GDPR or the California Consumer Privacy Act), you may have the right to:

  • access the personal data we hold about you;
  • correct inaccurate data (you can edit most profile data yourself);
  • delete your data (you can delete your account from your dashboard at any time);
  • receive a copy of your data in a portable format;
  • object to or restrict certain processing;
  • withdraw consent where we rely on it;
  • complain to a data protection authority, for example [RELEVANT AUTHORITY, e.g. the UK Information Commissioner's Office (ico.org.uk)].

California residents: we do not sell or "share" personal information for cross-context behavioural advertising, and we will not discriminate against you for exercising your rights.

To exercise any right, email [PRIVACY CONTACT EMAIL]. We may need to verify your identity before acting on your request. We aim to respond within one month.

11. SECURITY

We use industry-standard measures to protect your data, including encrypted connections (HTTPS), hashed passwords, access controls on uploaded files and private messaging channels, and restricted administrator access. No system is completely secure, so we cannot guarantee absolute security.

12. CHILDREN

The Platform is not intended for anyone under [16 / 18]. We do not knowingly collect personal data from children. If you believe a child has given us personal data, contact us and we will delete it.

13. CHANGES TO THIS POLICY

We may update this policy from time to time. If we make significant changes, we will notify you by email or through the Platform. The "Last updated" date at the top shows when it last changed.
